1. Nature of the Service

Rubrisense ("the Service", "Platform", "we", "us", "our") is a Clinical Decision Support System (CDSS) designed and built exclusively for licensed homeopathic practitioners. The Platform provides AI-assisted case-taking, symptom analysis, repertorization, and remedy suggestions with the sole purpose of supporting a practitioner's own clinical reasoning β€” not replacing it.

This Platform is NOT a medical device, does NOT diagnose disease, does NOT prescribe treatment, and does NOT provide medical advice of any kind to any person.

  • β€’ All AI-generated content on this Platform β€” including repertorization results, remedy suggestions, symptom mappings, intake form questions, and lab report interpretations β€” is provided for informational and decision-support purposes only.
  • β€’ AI outputs may contain errors, inaccuracies, hallucinations, or incomplete information. They must never be relied upon as the sole basis for any clinical decision.
  • β€’ The final clinical decision β€” including diagnosis, treatment selection, posology, and patient management β€” rests solely and exclusively with the attending licensed practitioner.
  • β€’ Patients must always be directed to consult a qualified, licensed homeopathic practitioner for all medical advice. No output from this Platform should ever be shared directly with patients as medical guidance.
  • β€’ This Platform does not establish a doctor–patient relationship between Rubrisense and any patient.

2. Restricted Access β€” Who May Use This Service

Access to this Platform is strictly restricted to the following categories of users:

  • Licensed, registered homeopathic practitioners (BHMS, DHMS, MD (Hom), or equivalent qualification recognised by a competent authority in their jurisdiction)
  • Authorised clinical and administrative staff employed by or contracted to such practitioners, operating under their direct supervision

The following persons are explicitly prohibited from accessing or using this Platform:

  • Members of the general public, patients, or individuals seeking medical information for personal use
  • Any person who does not hold a valid and current licence to practise medicine or homeopathy in their jurisdiction
  • Any person acting outside the scope of their professional licence

Creating an account on this Platform constitutes a binding declaration that you meet the eligibility requirements above. We reserve the right to terminate any account where eligibility cannot be verified or where these requirements are found to have been misrepresented.

3. Acceptance of Terms

By accessing, registering for, or using this Service, you agree to be bound by these Terms of Service, our Privacy Policy, and our Refund & Cancellation Policy. If you do not agree to these terms in full, you must immediately cease using the Platform and close your account.

If you are accessing the Platform on behalf of a clinic, hospital, or organisation, you represent that you have the authority to bind that organisation to these terms.

4. Practitioner Responsibilities

By using this Service, you agree to:

  • Maintain a valid and current licence to practise homeopathy throughout your use of the Platform
  • Exercise independent professional clinical judgement on all AI-generated suggestions before any clinical application
  • Inform patients that AI-assisted tools are used as part of clinical decision support, and obtain appropriate informed consent
  • Comply with all applicable laws, regulations, and professional standards in your jurisdiction, including β€” but not limited to β€” the Indian Medical Council Act, Homoeopathy Central Council Act 1973, and the DPDP Act 2023
  • Store, use, and manage patient data responsibly and only for legitimate clinical purposes
  • Never share AI-generated outputs directly with patients as medical diagnoses or treatment recommendations
  • Immediately notify us of any security breach, unauthorised access, or misuse of your account
  • Keep your account credentials confidential and not share them with unauthorised individuals

5. AI Features β€” Capabilities and Limitations

The Platform includes the following AI-assisted features:

  • Dynamic intake form generation based on chief complaints
  • Automated symptom-to-rubric mapping using Kent's Repertory (3,000+ rubrics)
  • Grade-weighted remedy scoring and repertorization
  • Retrieval-Augmented Generation (RAG) from classical homoeopathic texts (Kent, Boericke, Materia Medica Pura)
  • Multimodal lab report interpretation (PDF and image uploads)
  • AI-assisted dosage suggestions
  • Conversational Q&A on patient records and lab reports

Inherent limitations of AI you must understand and accept:

  • AI models can produce hallucinations β€” plausible-sounding but factually incorrect outputs. This can include incorrect rubric mappings, wrong remedy associations, or inaccurate lab interpretations. You must always verify AI outputs against authoritative sources.
  • AI does not have access to information outside its training data and indexed knowledge base. Clinical nuances, rare presentations, and recently published research may not be reflected.
  • AI suggestions do not account for the full complexity of an individual patient's constitution, modalities, and totality of symptoms in the way an experienced classical homeopath can. They are starting points, not conclusions.
  • The accuracy of outputs is directly dependent on the quality and completeness of the information entered by the practitioner.

6. Data Ownership

All patient data, consultation records, prescriptions, and clinical notes entered into the Platform by a practitioner remain the sole property of that practitioner. We act strictly as a data processor on your behalf. We will never use, sell, share, or otherwise exploit patient records for any purpose other than operating the Service on your instruction.

You may export all your data at any time from your account. Upon account closure, you may request permanent deletion of all data.

7. Data Security

We implement the following security measures to protect data:

  • Patient personally identifiable information (name, phone, email, address, medical history) is encrypted at the database column level β€” a data breach of our database would not expose readable patient data
  • All data is transmitted over HTTPS/TLS
  • Each practice's data is logically isolated from all other practices
  • Role-based access controls ensure team members can only access data appropriate to their role
  • Comprehensive audit logs record all sensitive operations

While we implement industry-standard security measures, no system is entirely immune to breach. You acknowledge this inherent risk and agree not to hold us liable for any breach resulting from circumstances outside our reasonable control.

8. Subscription, Billing, and Payments

The Platform is offered on a subscription basis. Subscription fees are charged in advance for the applicable billing period. By subscribing, you authorise us to charge your payment method on a recurring basis until you cancel.

AI-assisted features additionally consume credits from a pre-paid wallet associated with your account. Credits are deducted per consultation. Wallet credits are non-refundable. See our Refund & Cancellation Policy for full details.

9. Intellectual Property

The Platform, including its software, design, source code, AI models, RAG knowledge base, and all associated content, is the exclusive intellectual property of Rubrisense and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the Platform solely for its intended clinical support purpose during your active subscription period.

You may not copy, modify, reverse engineer, distribute, sublicence, or create derivative works from any part of the Platform.

Kent's Repertory content indexed within the Platform is in the public domain. Materia Medica content from classical homoeopathic texts is similarly in the public domain where applicable. Our AI models, indexing, scoring algorithms, and prompt engineering constitute proprietary intellectual property.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Rubrisense, its directors, employees, contractors, and agents shall not be liable for:

  • Any patient harm, adverse outcome, or clinical consequence resulting from the use of, reliance on, or misuse of AI-generated suggestions or any other Platform content
  • Errors, inaccuracies, incompleteness, or hallucinations in AI outputs, repertorization results, remedy suggestions, or lab report interpretations
  • Any treatment decision, diagnosis, or prescription made by a practitioner whether informed by Platform outputs or not
  • Loss of data, interruption of service, or system downtime
  • Any indirect, incidental, consequential, special, or punitive damages of any kind
  • Any claims arising from a practitioner's use of the Platform in a manner inconsistent with these Terms or their professional obligations

Our aggregate liability to you for any claim arising out of or relating to these Terms or your use of the Platform shall not exceed the total subscription fees paid by you in the three (3) months immediately preceding the event giving rise to the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Rubrisense, its directors, employees, contractors, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

  • Your use of the Platform
  • Your breach of these Terms
  • Any clinical decision or treatment made by you, whether or not related to AI outputs from the Platform
  • Any violation of applicable law or regulation by you
  • Your misrepresentation of your qualifications, licensure, or eligibility to use the Platform
  • Any claim brought by a patient or third party arising from your clinical practice

12. Privacy

Your use of the Platform is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the data practices described therein.

13. Account Termination

You may close your account at any time. Upon closure:

  • Your access to the Platform will be immediately revoked
  • You may request a full export of your patient data before closure
  • Data will be deleted within 30 days unless a longer retention period is required by applicable law
  • Subscription fees already charged are non-refundable except as set out in our Refund Policy

We reserve the right to suspend or terminate your account, without notice and without liability, if:

  • You breach any provision of these Terms
  • We determine that your account has been accessed by or on behalf of a person not eligible to use the Platform
  • Continued access poses a risk to the security or integrity of the Platform or data of other users
  • Required by applicable law or regulation

14. Modification of Terms

We may update these Terms at any time. Material changes will be communicated via email or an in-app notice at least 14 days before they take effect. Continued use of the Platform after changes take effect constitutes your acceptance of the revised Terms.

15. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India. Any dispute arising out of or relating to these Terms or the Platform shall first be referred to good-faith negotiation between the parties for a period of 30 days. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts in India.

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy and Refund & Cancellation Policy, constitute the entire agreement between you and Rubrisense with respect to the Platform and supersede all prior agreements, representations, and understandings.
